Brewer's appeal denied by racing commission

DAYTONA BEACH, Fla. -- On Tuesday, the National Stock Car Racing Commission heard and considered the Appeal of Timothy Brewer. The Appeal concerned a $5,000 fine issued by NASCAR under Section 12-4-A; "actions detrimental to stock car racing" and Section 12-4-Q; "any determination by NASCAR Officials that Parts and/or equipment used in the Event do not conform to NASCAR rules: non-approved rear deck lid -- did not fit templates."

The penalty pertained to the No. 4 NASCAR Nextel Cup Series car at Darlington Raceway on March 19.

The violation was clear and failure of the deck lid to conform to the template was not disputed by the Appellant. The penalty was consistent with penalties for similar NASCAR Nextel Cup Series rear deck lid violations.

It is therefore the unanimous decision of the National Stock Car Racing Commission to uphold the original penalty issued by NASCAR. The Appellant has the right under Section 15 of the Rule Book to appeal this decision to the National Stock Car Racing Commissioner.
