1. NO PURCHASE NECESSARY to enter or to win. The "Win the King" Sweepstakes ("Sweepstakes") is open to legal residents of the 48 contiguous United States and the District of Columbia at least 18 years of age at the time of entry. Employees and their immediate families (spouses, siblings, children, household members and the spouses and children of the foregoing) of Turner Sports Interactive, Inc, and Richard Petty Enterprises (the "Sponsors"), the National Association of Stock Car Auto Racing, Inc. ("NASCAR"), the National Broadcasting Company ("NBC"), Turner Network Television LP, LLLP, AOL Time Warner, Inc., Hothouse Inc., and their respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies and affiliated entities (collectively, the "Sweepstakes Entities") are not eligible to enter the Sweepstakes. By entering the Sweepstakes, participants agree to abide by all terms of the Official Rules and Regulations applicable thereto. Subject to all local, state and federal laws and regulations. Void wherever prohibited or restricted by law.
2. HOW TO ENTER: During the Dover Winston Cup Race (the "Race") on September 22, 2002, the announcers will state the track position of each of the Petty Enterprises Winston Cup Series cars that qualifies (Cars #43, #44, #45) (the "Petty Cars") for a specific lap and encourage viewers to enter the Sweepstakes (the "Sweepstakes Entry Spot"). The Sweepstakes Entry Spot will occur between 1:00 - 4:00 p.m. (ET/PT) on September 22, 2002. There are two (2) ways to enter. Online: Access the NASCAR.com web page via www.nascar.com and locate the Sweepstakes banner or button located there, follow the instructions at the Sweepstakes web page to get to an Official Sweepstakes Entry Form. Enter name, address, age, telephone number and email (optional) as well as the number of the Petty Car closest to position one (1) announced during the Sweepstakes Entry Spot and submit the Entry Form.
By Phone: Viewers may also enter via a toll free number. To enter by phone, viewers will be asked to call 1-800-977-7700 and each caller to get through will be asked to audibly and completely supply their name, address, age and telephone number as well as the number of the Petty Car closest to position one (1) announced during the Sweepstakes Entry Spot. To be eligible, all entries must be received no later than 12:00 p.m. (ET) on September 23, 2002.
Track position will be determined according to official NASCAR Timing & Scoring. If no Petty Enterprises Winston Cup Series car participates in the Race, winners will be determined by a random drawing from all eligible entries. Limit one (1) entry per person, e-mail address or household regardless of method of entry. No mechanical reproductions or facsimiles accepted. All entries must be submitted in the name of or represent an individual person and prizes can only be awarded to the person whose name is on or correlates to each winning entry. Computer generated calls will not be accepted. Sponsors are not responsible for misdirected, incomplete, or late entries, technical failures of any kind, or other errors or problems of any kind which may limit a participant's ability to participate in the Sweepstakes. Sponsors are not responsible for pre-emptions, blackouts or any other non-controllable acts concerning the television broadcast. Sponsors are also not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed software transmissions which may limit an participants ability to participate in the sweepstakes or damage to user's system as a result of participation in the sweepstakes or downloading any information necessary to participate in the sweepstakes. Sponsors reserve the right in their sole discretion, to cancel or modify the Sweepstakes should any computer virus, malfunction or other cause beyond their control corrupt the administration, security or proper operation of the Sweepstakes. If the Race is cancelled, postponed, delayed or rescheduled for any reason whatsoever, Sponsors may elect to cancel, postpone, delay or reschedule the Sweepstakes. All entries become the property of the Sponsors and will not be acknowledged or returned. False or deceptive entries or acts, as determined by Sponsors, will render the participant ineligible.
3. HOW TO WIN: Thirty Six (36) Winners will be selected on or about October 1, 2002, by random drawing conducted by independent judging agency from among all the eligible, correct online and call-in entries received. The odds of winning will be determined by the number of eligible, correct online and call-in entries received. Odds of winning will be equal regardless of method of entry. Sweepstakes will be administered by Hothouse and the Sponsors, the decisions of which in all matters regarding the Sweepstakes are final and binding. The winners will be notified by phone; email and/or mail and must meet all eligibility requirements including the execution and delivery of all necessary releases. If a dispute arises regarding who submitted an on-line entry, the entry will be deemed submitted by the holder of the e-mail account as determined by Sponsors.
4. PRIZES:
GRAND PRIZE: One grand prize winner ("Grand Prize Winner") will receive the following: A one (1)-hour appearance for two (2) by Richard Petty in Grand Prize Winner's hometown at a location to be determined by Sponsors ("Appearance") at an approximate market value ("AMV") of Four Thousand Dollars ($4,000.00) and one (1) Win the King Prize Pack of various premium items provided by Sponsors at an AMV of Two Hundred Dollars ($200.00). AMV of Grand Prize (1) Four Thousand Two Hundred Dollars ($4,200.00). The date of the Appearance will be mutually agreed upon by the Sponsors and the Grand Prize Winner and must occur within twelve (12) months of Sponsors awarding the Grand Prize to Grand Prize Winner. The guidelines of the Appearance including timing, activities, and number of individuals included are at the Sponsors' sole discretion.
FIRST PLACE PRIZE: Ten (10) First Place Prize winners (the "First Place Winners") will receive the following: A certificate good for one (1) Richard Petty Driving Rookie Experience (the "Experience") at a racetrack participating in the Experience program ("Participating Racetrack") at an AMV of Four Hundred Dollars ($400.00) each. AMV of First Place Prizes (10) Four Thousand Dollars ($4,000.00). If any First Place Winner resides more than 100 miles from a Participating Racetrack, Sponsors will provide transportation of Sponsors' choosing for First Place Winner to and from a Participating Racetrack nearest First Place Winner's residence, with the exception of those racetracks listed below. First Place Winners will not able to redeem their certificates for the Experience at the following racetracks: Daytona, Talladega, or Indianapolis. First Place Winners have one (1) calendar year from the date they receive notice they have been awarded the First Place Prize to redeem it.
SECOND PLACE PRIZE: Twenty Five (25) Second Place Prize winners (the "Second Place Winners") will receive the following: One (1) TNT hat at an AMV of Ten Dollars ($10.00) each. AMV of Second Place Prizes (25 prizes) is Two Hundred and Fifty Dollars ($250.00).
TOTAL (AMV) OF SWEEPSTAKES: (36 prizes) is EIGHT THOUSAND FOUR HUNDRED AND FIFTY DOLLARS ($8,450.00).
Grand Prize Winner and First Prize Winners are responsible for all expenses and taxes not included in the prize packages set forth above, including, without limitation, ground transportation, meals, souvenirs, and other personal expenses.
The reporting and payment of any tax liabilities incurred by the participant as a result of this sweepstakes and any prize won are the sole responsibility of the participant. No substitution or transfer of prize or cash redemptions permitted by winner. The Sweepstakes Entities reserve the right to substitute a prize of like value in the event the described prizes, or any portion thereof, is unavailable for any reason whatsoever. All prizes will be awarded.
5. GENERAL RULES AND REGULATIONS: By entering the Sweepstakes, participants grant Sweepstakes Entities the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, for the purpose of advertising and publicizing the goods and services of the Sweepstakes Entities and all matters related to the Sweepstakes in any manner or medium, throughout the world in perpetuity. Winner(s) and guest may each be required to sign affidavits of eligibility, tax acknowledgement forms, liability releases and, except where prohibited by law, use of name and likeness releases ("Winner Documents") and return within ten (10) days of issuance. Noncompliance within this time period may result in disqualification. Return of the prize or prize notification as undeliverable will result in disqualification and an alternate may be selected at the Sweepstakes Entities' discretion. In the event the winner declines the prize or fails to return completed releases, Sweepstakes Entities' may elect, at their own discretion, to select an alternate winner. By entering, participants agree to release the Sweepstakes Entities from any and all liability claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize, or while preparing for, participating in, and/or traveling to any prize-related activity. The Sweepstakes Entities expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, seeding, human, or other error or problem, a random drawing will take place from all eligible prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Official Rules.
In the event of sabotage, acts of God, computer virus or other events or causes beyond the Sponsors' reasonable control that corrupt the integrity, administration, security or proper operation of the Sweepstakes, Sponsors reserve the right to cancel or suspend the Sweepstakes. In the event of cancellation, prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring such cancellation. Notice of cancellation will be posted at www.nascar.com.
6. Construction: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sweepstakes Entities, shall be governed by, and construed in accordance with the laws of Georgia. In any action brought to enforce the obligation or right of any party hereunder they consent to personal jurisdiction and venue in any court of appropriate jurisdiction in Fulton County, Georgia, USA. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.
