THE ATARI DEER HUNTER SWEEPSTAKES
OFFICIAL RULES AND REGULATIONS NO PURCHASE NECESSARY 1. NO PURCHASE NECESSARY. The Atari Deer Hunter Sweepstakes ("Sweepstakes") is open to legal residents of the 48 contiguous United States and the District of Columbia at least 18 years of age at the time of entry, and who have had Internet access as of November 7, 2003. Employees and their immediate families (spouses, siblings, children, household members and the spouses and children of the foregoing) of Turner Sports Interactive, Inc. (the "Sponsor"), Atari, Inc. ("Atari"), and AOL Time Warner, Inc., ("AOLTW" (collectively, the "Sweepstakes Entities"), the National Association of Stock Car Auto Racing, Inc. ("NASCAR, Inc."), and their respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies, affiliated stations, and affiliated entities (collectively "affiliates")are not eligible to enter the Sweepstakes. By entering the Sweepstakes, participants agree to abide by all terms of the Official Rules and Regulations applicable thereto. Subject to all local, state and federal laws and regulations. Void wherever prohibited or restricted by law. 2. HOW TO ENTER. Beginning November 7, 2003, go to www.nascar.com and click the Sweepstakes promotional banner. Participants will register for the Sweepstakes by providing name, address, birth date, phone number (with area code), and email address (if available). On-line entry ends 11:59 PM Eastern Time ("ET") on December 5, 2003. Use of any automated entry software is prohibited. One (1) entry per person. All entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event of a dispute as to the identity of an entrant, all on-line entries will be deemed to have been submitted by the authorized account holder. Any participant who attempts to enter with multiple e-mail addresses or under multiple identities, or uses any other device to enter multiple times will be disqualified. All entries become the property of Sponsors and will not be returned. Sweepstakes Entities are not responsible for any problem or technical malfunction of any telephone network or lines, computer on-line systems, servers, equipment or software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, phone lines, or any combination thereof, including any injury or damage to a participant's computer related to or resulting from participation in this Sweepstakes. 3. HOW TO WIN. One (1) grand prize winner ("Grand Prize Winner") and, Twenty (20) second place winner ("Second Place Winners"), will be selected on or about December 8, 2003 by random drawing conducted by Sponsors from among all the eligible entries received. The odds of winning will be determined by the number of eligible entries received. The decisions of Sponsors will be final and binding. The winners will notified by phone; email and/or mail and must meet all eligibility requirements including the execution and delivery of all necessary releases. The reporting and payment of any tax liabilities incurred by the entrant as a result of this Sweepstakes and any prizes won are the sole responsibility of the entrant. No substitution or transfer of prize or cash redemptions permitted by winners. The Sponsors reserve the right to substitute prizes of like value in the event the described prizes, or any portion thereof, is unavailable for any reason whatsoever. All prizes will be awarded. 4. PRIZES. Grand Prize: One (1) Grand Prize Winner will receive a trip for two (2) to the 2004 "Golden Corral Race" in Atlanta, GA on March 14, 2004 (the "Trip") including the following: (i) round trip coach airfare for two (2) from Grand Prize winner's nearest gateway airport to Atlanta, GA; (ii) two (2) nights hotel accommodations, standard room at double occupancy of Sponsors' choice, (iii) rental car of Sponsor's choice for three (3) days, and (iv) two (2) tickets to the 2004 "Golden Corral Race". The Approximate Market Value ("AMV") for the Grand Prize is Two Thousand Five Hundred Dollars ($2,500). Twenty (20) Second Place Prize Winners will each receive an Atari Deer Hunter game at an AMV of Thirty Dollars ($30) each (total $600). Total AMV of all prizes is Three Thousand One Hundred Dollars ($3,100). 5. GENERAL RULES AND REGULATIONS: By entering the Sweepstakes, participants grant Sweepstakes Entities the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, for the purpose of advertising and publicizing the goods and services of the Sweepstakes Entities and all matters related to the Sweepstakes in any manner or medium, throughout the world in perpetuity. Winners may be required to sign affidavits of eligibility, tax acknowledgement forms, liability releases and, except where prohibited by law, use of name and likeness releases ("Winner Documents") and return within five (5) days of issuance. Noncompliance within this time period may result in disqualification. Return of the prize or prize notification as undeliverable or failure of potential winners to respond to notification attempts made within three (3) days of Winners' notification will result in disqualification and an alternate may be selected at the Sponsors' discretion. In the event a winner declines his or her prize or fails to return completed releases, Sponsors' may elect, at their own discretion, to select an alternate winner. By entering, participants agree to release the Sweepstakes Entities from any and all liability claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize, or while preparing for, participating in, and/or traveling to any prize-related activity. The Sweepstakes Entities expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, seeding, human, or other error or problem, a random drawing will take place from all eligible prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Official Rules. Grand Prize Winner is responsible for all travel documentation, including having a valid driver's license, and must complete the Grand Prize trip by March 15, 2004 or otherwise forfeit any claim to such prize package. Airline chosen at Sponsors' sole discretion. All other potential winners will receive their prizes within 4 to 6 weeks of notification. Actual value of prizes may vary based on timing and point of departure. Grand Prize winner is responsible for all expenses and taxes not included in the prize package, including, without limitation, all ground transportation (other than the ground transportation included in the prize package), parking, meals, room service, souvenirs, phone calls, incidentals, tips, and other personal expenses. If technical difficulties of any kind compromise the integrity or ability to continue on-line entry, TSI reserves the right to modify or terminate on-line entry. "NASCAR" AND "NASCAR.COM" are trademarks of the National Association for Stock Car Auto Racing, Inc. In the event of sabotage, acts of God, computer virus or other events or causes beyond the Sponsors' reasonable control which corrupt the integrity, administration, security or proper operation of the Sweepstakes, Sponsors reserve the right to cancel or suspend the Sweepstakes. In the event of cancellation, prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring such cancellation. Notice of cancellation will be posted at www.nascar.com. 6. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sweepstakes Entities, shall be governed by, and construed in accordance with the laws of Georgia. In any action brought to enforce the obligation or right of any party hereunder they consent to personal jurisdiction and venue in any court of appropriate jurisdiction in Fulton County, Georgia, USA. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.
