THE DENNY'S DASH SWEEPSTAKES OFFICIAL RULES AND REGULATIONS
1. NO PURCHASE NECESSARY. The Denny's Dash Sweepstakes ("Sweepstakes") is open to legal residents of the continental United States, at least 18 years of age at the time of entry. Turner Sports Interactive, Inc. ("TSI") and Denny's Inc. ("Denny's) (collectively the "Sponsors"), National Association for Stock Car Auto Racing, Inc. ("NASCAR") and its drivers, teams and properties, and each of their respective parents, affiliates, subsidiaries, franchises, dealers or retailers, advertising or promotion agencies (collectively the "Sweepstakes Entities") are not eligible to win any prizes, nor are members of such employees' families or households. By entering the Sweepstakes, participants agree to abide by all terms of the Official Rules and Regulations applicable thereto. Subject to all local, state and federal laws and regulations. Some restrictions apply. Void wherever prohibited or restricted by law.
2. HOW TO ENTER. Beginning August 1, 2003, go to www.nascar.com and click the Sweepstakes promotional banner. Participants will register for the Sweepstakes by providing name, address, birth date, phone number (with area code), and email address (if available). On-line entry ends 11:59 P.M. Eastern Time ("ET") on September 1, 2003. Use of any automated entry software is prohibited. One (1) entry per person. All entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event of a dispute as to the identity of an entrant, all on-line entries will be deemed to have been submitted by the authorized account holder. Any participant who attempts to enter with multiple e-mail addresses or under multiple identities, or uses any other device to enter multiple times will be disqualified. All entries become the property of Sponsors and will not be returned. Sweepstakes Entities are not responsible for any problem or technical malfunction of any telephone network or lines, computer on-line systems, servers, equipment or software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, phone lines, or any combination thereof, including any injury or damage to a participant's computer related to or resulting from participation in this Sweepstakes.
3. HOW TO WIN. One (1) grand prize winner ("Grand Prize Winner") will be selected on or about September 8, 2003 by random drawing conducted by Sponsors from among all the eligible entries received. The odds of winning will be determined by the number of eligible entries received. The decisions of Sponsors will be final and binding. The Grand Prize Winner will be notified within fourteen (14) days of selection by phone; email and/or mail and must meet all eligibility requirements including the execution and delivery of all necessary releases.
The reporting and payment of any tax liabilities incurred by the entrant as a result of this sweepstakes and any prize won are the sole responsibility of the entrant. No substitution or transfer of prize or cash redemptions permitted by winner. The Sweepstakes Entities reserve the right to substitute a prize of like value in the event the described prizes, or any portion thereof, is unavailable for any reason whatsoever. All prizes will be awarded.
4. PRIZES.
Grand Prize: One (1) Grand Prize Winner (the "Grand Prize Winner") will receive two (2) certificates to the "Richard Petty Driving Experience" ("Grand Prize") at one (1) of the following racetracks of Grand Prize Winner's choice: Atlanta Motor Speedway, Atlanta, GA; ChicagoLand Speedway, Joliet, IL; Kansas City Speedway, Kansas City, KS; Michigan International Speedway, Brooklyn, MI; Lowe's Motor Speedway, Concord, NC; North Carolina Speedway, Rockingham, NC; New Hampshire International Speedway, Loudon, NH; Darlington Raceway, Darlington, SC; Texas Motor Speedway, Forth Worth, TX; Nazareth Speedway, Nazareth, PA; Kentucky Speedway, Sparta, KY; California Speedway, Fontana, CA, Las Vegas Motor Speedway, Las Vegas, Nevada; Milwaukee Mile, West Allis, WI; Gateway Int'l Raceway, Madison, IL; Homestead - Miami Speedway, Homestead, FL; Phoenix Int'l Raceway, Phoenix, AZ; Pikes Peak Int'l Raceway, Fountain, CO; Richmond Int'l Raceway; Richmond, VA; Talladega Superspeedway, Talladega, AL; and Walt Disney World Speedway, Orlando FL ("Participating Racetrack"). If the Grand Prize Winner chooses a Participating Racetrack that is more than 100 miles from his or her residence, Sponsor will provide transportation to and from the Participating Racetrack, and one night accommodation of Sponsor's choosing. The approximate market value ("AMV") for the Grand Prize is Four Thousand Dollars ($4,000). Certificates are subject to the terms and conditions therefor, and of the Richard Petty Driving Experience.
5. GENERAL RULES AND REGULATIONS: By entering the Sweepstakes, participants grant Sweepstakes Entities the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, for the purpose of advertising and publicizing the goods and services of the Sweepstakes Entities and all matters related to the Sweepstakes in any manner or medium, throughout the world in perpetuity. Winner may be required to sign affidavits of eligibility, tax acknowledgement forms, liability releases and, except where prohibited by law, use of name and likeness releases ("Winner Documents") and return within seven (7) days of issuance. Noncompliance within this time period may result in disqualification. Return of the prize or prize notification as undeliverable or failure of potential winner to respond to notification attempts made within fourteen (14) days of Grand Prize Winner's notification will result in disqualification and an alternate may be selected at the Sweepstakes Entities' discretion. In the event the winner declines the prize or fails to return completed releases, Sweepstakes Entities' may elect, at their own discretion, to select an alternate winner. By entering, participants agree to release the Sweepstakes Entities from any and all liability claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize, or while preparing for, participating in, and/or traveling to any prize-related activity. The Sweepstakes Entities expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, seeding, human, or other error or problem, a random drawing will take place from all eligible prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Official Rules.
Grand Prize Winner is responsible for all travel documentation and must complete the Grand Prize trip by September 8, 2004 or otherwise forfeit any claim to such prize package. If applicable, airline chosen at Sponsors' sole discretion. The Grand Prize winner must also provide thirty (30) days written notice to allow for travel arrangements and accommodations, which are subject to availability. Certain blackout periods and other restrictions may apply. Actual value of prize may vary based on timing and point of departure. Grand Prize winner is responsible for all expenses and taxes not included in the prize package, including, without limitation, all ground transportation (other than the ground transportation included in the prize package), parking, meals, room service, souvenirs, phone calls, incidentals, tips, and other personal expenses.
If technical difficulties of any kind compromise the integrity or ability to continue on-line entry, TSI reserves the right to modify or terminate on-line entry. "NASCAR" AND "NASCAR.COM" are trademarks of the National Association for Stock Car Auto Racing, Inc. In the event of sabotage, acts of God, computer virus or other events or causes beyond the Sponsors' reasonable control which corrupt the integrity, administration, security or proper operation of the Sweepstakes, Sponsors reserves the right to cancel or suspend the Sweepstakes. In the event of cancellation, prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring such cancellation. Notice of cancellation will be posted at www.nascar.com.
6. Construction: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sweepstakes Entities, shall be governed by, and construed in accordance with the laws of Georgia. In any action brought to enforce the obligation or right of any party hereunder they consent to personal jurisdiction and venue in any court of appropriate jurisdiction in Fulton County, Georgia, USA. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.
