1. NO PURCHASE NECESSARY. The NASCAR.com Pepsi 400 Signed Helmet Sweepstakes (the "Sweepstakes") is open to legal residents of the 50 United States, and District of Columbia, at least 18 years at time of entry. Employees and their immediate families (spouses, siblings, children, household members and the spouses and children of the foregoing) of Turner Sports Interactive, Inc. ("TSI") and the Daytona International Speedway (collectively, the "Sponsors"), National Association for Stock Car Auto Racing, Inc. ("NASCAR") and its drivers, teams and properties, and each of their respective parents, affiliates, subsidiaries, dealers or retailers, advertising or promotion agencies (collectively the "Sweepstakes Entities") are not eligible to win any prizes, nor are members of such employees' families or households. By entering the Sweepstakes, participants agree to abide by all terms of the Official Rules and Regulations applicable thereto. Subject to all local, state and federal laws and regulations. Some restrictions apply. Void wherever prohibited or restricted by law.
2. HOW TO ENTER. Beginning June 12, 2003 go to www.nascar.com and click the Sweepstakes promotional banner. Participants will register for the Sweepstakes by providing name, address, birth date, phone number (with area code), and email address (if available). On-line entry ends 3:59 P.M. Eastern Time ("ET") on July 3, 2003. One (1) entry per person. Use of any automated entry software is prohibited. In the event of a dispute as to the identity of a participant, all on-line entries will be deemed to have been submitted by the owner of the e-mail account address. All entries become the property of Sponsors and will not be returned. Sweepstakes Entities are not responsible for any problem or technical malfunction of any telephone network or lines, computer on-line systems, servers, equipment or software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, phone lines, or any combination thereof, including any injury or damage to a participant's computer related to or resulting from participation in this Sweepstakes.
3. HOW TO WIN. One (1) grand prize winner (the "Grand Prize Winner") will be selected on or about July 7, 2003, by random drawing conducted by Sponsors from among all the eligible entries received. The odds of winning will be determined by the number of eligible entries received. The Grand Prize Winner will be notified by phone; email and/or mail and must meet all eligibility requirements including the execution and delivery of all necessary releases.
4. PRIZES: One (1) Pepsi 400 racing helmet autographed by the drivers participating in the Pepsi 400 on July 5, 2003 (the "Grand Prize"). Approximate market value ("AMV") of Grand Prize: Three Hundred Dollars and 00/100 ($300.00).
The reporting and payment of any tax liabilities incurred by the entrant as a result of this Sweepstakes and any prize won are the sole responsibility of the entrant. No substitution or transfer of prize or cash redemptions permitted by winner. The Sponsors reserve the right to substitute a prize of like value in the event the described prizes, or any portion thereof, is unavailable for any reason whatsoever. All prizes will be awarded.
5. GENERAL RULES AND REGULATIONS: By entering the Sweepstakes, participants grant Sponsors the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, for the purpose of advertising and publicizing the goods and services of the Sponsors and all matters related to the Sweepstakes in any manner or medium, throughout the world in perpetuity. Grand Prize Winner may be required to sign affidavits of eligibility, tax acknowledgement forms, liability releases and, except where prohibited by law, use of name and likeness releases ("Winner Documents") and return within ten (10) days of issuance. Noncompliance within this time period may result in disqualification. Return of the prize or prize notification as undeliverable or failure of potential winner to respond to notification attempts will result in disqualification and an alternate may be selected at the Sponsors' discretion. In the event the winner declines the prize or fails to return completed releases, Sponsors may elect, at their own discretion, to select an alternate winner. By entering, participants agree to release the Sweepstakes Entities from any and all liability claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize, or while preparing for, participating in, and/or traveling to any prize-related activity. The Sweepstakes Entities expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, seeding, human, or other error or problem, a random drawing will take place from all eligible prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Official Rules. "NASCAR" AND "NASCAR.COM" are trademarks of the National Association for Stock Car Auto Racing, Inc. Sponsor will mail the Grand Prize to the Grand Prize Winner within eight (8) weeks of Sponsor's receipt of all completed executed Winner Documents.
In the event of sabotage, acts of God, computer virus or other events or causes beyond the Sweepstakes Entities' control, which corrupt the integrity, administration, security or proper operation of the Sweepstakes, Sponsors' reserve the right, in their sole discretion, to modify, cancel or suspend the Sweepstakes. In the event of cancellation, Sponsors reserve the right to award prizes from among all eligible, non-suspect entries received prior to the event requiring such cancellation. Notice of cancellation will be posted at www.nascar.com.
6. CONSTRUCTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sweepstakes Entities, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Georgia. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
