By using this admission (“Ticket”) to the event (“Event”) at Daytona International Speedway (“Track”), Ticket holder (“Patron”), on his/her own behalf and on behalf of any minor accompanying Patron to the Event (“Minor”) expressly agrees to the following terms and conditions. Track may change terms and conditions at any time, without notice. Patron’s use of the Ticket after such posted change is Patron’s acceptance of such change(s). Patron is solely responsible for reading and understanding all terms before using this Ticket.
ALL TICKET SALES ARE FINAL – NO REFUNDS – NO EXCHANGES – EVENT DATE & TIME SUBJECT TO CHANGE. In the event of a postponement, this Ticket will be honored on the date the Event is held.
Tickets obtained from sources other than Track or its affiliates may be lost, stolen, or counterfeit, and in such cases will not be honored. Tickets may not be resold at a price higher than printed on Ticket. Tickets may not be resold for any price on Track property. Tickets may not be used for advertising, promotions (including contests, sweepstakes or giveaways) or other trade purposes, without the prior written consent of Track.
Patron for him/herself and on behalf of Minor(s) expressly assumes all risk incident to the Event, whether occurring prior to, during or subsequent to the Event. Patron recognizes that attendance at Event is voluntary and may result in personal injury, including possible death, and/or property damage and agrees to stay alert and remain aware of the surroundings and the surroundings of Minor(s). Patron agrees that all participants, sanctioning bodies, and all employees, agents, officers, and directors of Track, its affiliates and subsidiaries are hereby released from any and all claims arising from the Event, including claims of negligence.
Patron/Minor(s) is subject to all rules and policies of the Track respecting access and use of the facilities and acknowledges and agrees that Patron and/or Minor(s) may be denied entry or ejected from the Event, without refund, if Patron and/or Minor(s): (a) violate any rules or policies of Track; (b) engage in conduct deemed by Track to be improper, disorderly, or unbecoming; (c) uses vulgar, derogatory, or abusive language; or (d) in the sole judgment of Track, engages in activity or causes a disturbance prohibiting attendees at Event from enjoying Event.
Patron/Minor(s) and/or any assigns, licensees, affiliates and successors of either irrevocably grant to Track the right to use Patron’s and/or Minor(s) image, likeness, voice, actions and/or statements in all forms and media including composite or modified representations for all purposes, including advertising, trade, or any commercial purpose throughout the world and in perpetuity. Patron waives any and all claims that Patron and/or Minor may have for libel, defamation, invasion of privacy or right of publicity, infringement of copyright or violation of any other right arising out of or relating to any utilization of either’s image as described herein.
NASCAR owns rights to broadcast, transmit, film, tape, capture, overhear, photograph, collect or record by any means (including but not limited to television, cable television, radio, pay-per-view, closed circuit television, satellite signal, digital signal, and the Internet) all images, sounds and data arising from or during any NASCAR Event and NASCAR shall be the sole owner of any and all copyrights, intellectual property rights, and proprietary rights worldwide in and to these works and in and to any other works, copyrightable or otherwise, created from the images sounds and data arising from or during any NASCAR Event. The bearer of any Tickets purchased via this document agrees not to take any action, or cause others to take any action, which would contravene, diminish, encroach or infringe upon these NASCAR rights.
