Terms and Conditions of Voting
ELIGIBILITY AND HOW TO VOTE
NO PURCHASE NECESSARY. The NASCAR Hall of Fame Class of 2020 Fan Vote (“HOF Vote”) is open worldwide. Voting for the HOF Vote begins at 12:00:00 PM Eastern Time on April 9th, 2019, and ends at 12:00:00 PM Eastern Time on May 20th, 2019 (“Voting Period”). During the Voting Period, visit the website for the HOF Vote, https://www.nascar.com/halloffame (“Website”) to view the list of eligible nominees. To cast your vote for a nominee, select the ‘select’ button for that nominee. You may select up to five (5) nominees per ballot submission, and then complete the form by providing your e-mail address or log into your Facebook or Google account from the Website. You may submit up to fifty (50) ballots per day per login method. Entries generated by script, macro or other automated means will be void and will result in disqualification of the vote from the HOF Vote as determined by Omnigon Communications, LLC (the “Administrator”), in consultation with National Association for Stock Car Auto Racing, Inc. (“NASCAR”). After casting your vote, you may be able to share your vote selection on your Facebook page or Twitter, which will also include a link to the Website. The five nominees with the most fan votes will make up the fan ballot, which will be submitted during the NASCAR Hall of Fame Class of 2020 Voting Panel Meetings.
The Administrator reserves the right, in consultation with NASCAR, to void suspect entries, or to modify, cancel, or suspend part or all of the HOF Vote should virus, bugs, non-authorized human intervention or other causes beyond the control of the Administrator corrupt or impair the administration, security, or fairness or proper play of the HOF Vote. If cancelled or terminated early, the Administrator, in consultation with NASCAR, will determine the eligible nominees receiving the most Votes by tallying the Votes that the Administrator, in consultation with NASCAR, finds to be valid at the time of termination or cancellation. If suspended, the Administrator, in consultation with NASCAR, will determine the eligible nominees receiving the most Votes by tallying the Votes that the Administrator, in consultation with NASCAR, finds to be valid at the time of suspension and the Votes accumulated when voting resumes. The Administrator may prohibit a participant from taking part in the Vote or disqualify a participant’s vote if, in consultation with NASCAR, it determines that said participant is attempting to undermine the legitimate operation of the HOF Vote by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, or threaten any other participant or representatives of Administrator and/or NASCAR. The Administrator and NASCAR assume no responsibility for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, including, but not limited to, the Facebook platform, computer equipment, software, failure of any entry to be received by the Administrator on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, whether caused by the Administrator, participants, or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the promotion. Rules and procedures are subject to change as determined by the Administrator, in consultation with NASCAR, without notice. All personally-identifiable information provided during the voting process will be treated in accordance with the privacy policies posted at https://www.nascar.com/privacy-policy/. By participating in this HOF Vote, you agree to the privacy policies and to the terms and conditions of Facebook and Twitter, and to the decisions of the Administrator and NASCAR, which decisions shall be final and legally binding in all respects.
CAUTION – ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE WEBSITE OR VOTING MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE ADMINISTRATOR AND NASCAR RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY PERPETRATOR OF SUCH ACTS TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
